Business Interruption Coverage Under COVID-19

During this seminar a panel of presenters including Frank Russo from Procor Solutions + Consulting, Lynn Allen of Tyson & Mendes, Sheri Wilson of Lockton Companies, and Tracy Alan Saxe of Saxe Doernberger & Vita, P.C., will discuss business interruption coverage under COVID-19. They will begin with an overview of property insurance coverage, the requirements for coverage including conditions, exclusions and typical first party property coverages that may reimburse business interruption losses, and approaches to claim prep and document losses. They will then dive into issues related to the current COVID-19 pandemic and provide a legal perspective on COVID-19 and non-COVID-19 policy coverage and claim prep as well as judicial predictions on COVID-19 as Property Damage, application of exclusions, prospective and retroactive legislative changes and funding for losses. 

Lynn Allen

Managing Partner, Tyson & Mendes

Lynn Allen is the Managing Partner of Tyson & Mendes’ Phoenix office. Ms. Allen is an experienced trial lawyer who represents her clients in a wide variety of complex cases, including insurance coverage disputes, insurance bad faith, defense of personal injury and wrongful death lawsuits, intellectual property, employment law, and appeals. Ms. Allen has extensive appellate experience in both the Arizona state and federal courts. She has been lead counsel in many successful jury trials, arbitrations, summary judgment motions, and appeals. She is a frequent lecturer on insurance bad faith and coverage issues in Arizona. Ms. Allen earned her J.D. cum laude from the Arizona State University College of Law in 1989, where she served as a note and comment editor on the Law Review. She is licensed to practice law in Arizona and is a member of the Maricopa County Bar Association and Arizona Association of Defense Counsel.

Frank Russo

Frank Russo is a founder of Procor Solutions + Consulting, a leading specialty consulting firm offering expertise in the areas of insurance risk management, disaster planning, claim preparation, construction claims, insurance appraisals and dispute resolutions. Frank is a recognized global thought leader on the topic of business resiliency having spoken and written many times throughout his career about business risk preparation and recovery strategies from major income-impacting disasters, losses or disputes.

Over his career, Frank has helped collect over $10 Billion dollars in loss recovery for his clients. He has actively guided clients through all the major large-scale disasters over the last twenty years including the terrorist acts of 9/11/01, 2017 Hurricane Season, Hurricane Katrina, the Gulf Oil Disaster and the Japan Earthquake/Tsunami to name a few. He also is involved in major construction and development projects when there is a need to professionally quantify, support and present incremental costs and schedule delays.

 Frank is an alumnus of Rutgers University, he holds an Executive MBA from the Lubin School of Business at Pace University, a Construction Risk Insurance Specialist (CRIS) designation from the International Risk Management Institute; an Associate in Risk Management designation from the Insurance Institute of America; and is a verified Cyber Insurance Risk Manager (CyRM). 

Frank was recently honored as a recipient of the “Innovator in Finance” Award from FiNext acknowledging the efforts of FinTech thought leaders and torchbearers of the industry.

Tracy Alan Saxe

President, Saxe Doernberger & Vita, P.C

Tracy Alan Saxe, President, Saxe Doernberger & Vita, P.C. is a skilled commercial litigator focused on insurance coverage on behalf of policyholders. He handles cases involving coverage for comprehensive general liability, directors and officers, professional liability, builder’s risk, sub-guard, first-party property damage, additional insured, and business interruption claims. Mr. Saxe has litigated insurance coverage matters all over the country and has successfully tried numerous jury and court trials in state and federal courts. He handles cases before the federal, state trial and appellate courts in Connecticut, New York, Pennsylvania, Virginia, Maryland, Massachusetts, California, Washington State, Texas, Illinois, Indiana, Michigan, and the District of Columbia He has successfully mediated and arbitrated many disputes. Mr. Saxe has been an Adjunct Professor of Law at Quinnipiac University where he taught Insurance Law. He frequently lectures on insurance coverage nationwide. 

Sheri Wilson

Senior Vice President & National Property Claim Director, Lockton Companies

Sheri has more than 25 years experience in property claims. She joined Lockton in 2012 and provides technical expertise, advocacy, and industry trend analysis for domestic and international property claim exposures. She leads the National Property Claim Catastrophe Team and is an active member of Lockton’s Global Property Practice.

Responsibilities include analysis of loss and exposure data, policy wording review and revision to ensure contract certainty, communication of adverse claim and loss trends to Lockton Associates and clients, and partnering with individual senior property claim leaders within each of the carrier markets, including elevation of claim issues.

In addition, she leads all CAT claim related activities and provides guidance, training and development, and thought leadership to the property claim resources contained within each of the local Lockton offices locations. A noted expert in property insurance claims, Sheri creates white papers, articles, and other resource materials on emerging issues and trends. She is a frequent speaker at Risk & Insurance Management Society (RIMS) events. She also is the author of several property claim-related technical reports.
